The Supreme Court sets penalty for Yash Raj Films on 22nd April 2024, Monday. A complaint had been filed by Afreen Fatima Zaidi, a movie viewer against Yash Raj Films. She claimed that she was cheated on in a promo song ‘Jabra Fan’ From the Bollywood movie ‘Fan’ which was not included in the movie. The Supreme Court set aside a National Consumer Disputes Redressal Commission (NCDRC) order Against the banner house of Yash Raj Films on the basis of this claim.

The supreme court also charged 10000 Rupees as the penalty from the Yash Raj Films because they didn’t use the song ‘Jabra Fan’ in Shahrukh Khan’s movie ‘Fan’. This song was shown in the promo and teaser of the movie Fan but it was completely absent from the movie. A bench of Justice PS Narasimha and Aravind Kumar has announced that the supreme court sets penalty of the NCDRC order against Yash Raj Films.

Supreme Court sets penalty for Yash Raj Films and charges 10000 RS. against the complaint of Afreen Fatima Zaidi. Afreen Fatima Zaidi made a complaint against Yash Raj Films and explained that she decided to watch Shahrukh Khan’s movie ‘Fan’ with her family after watching its promo and the song ‘Jabra Fan’. Afreen Fatima Zaidi stated that she and her children watched the song Jabra Fan in the promo but when they went to the theatre it was missing from the entire movie. She felt cheated and decided to make a complaint in the district forum.

The complaint was dismissed by the district forum and then she approached the State Consumer Disputes Redressal Commission, Maharashtra. After her second complaint, the Supreme Court sets penalty for Yash Raj Films. The production house submitted that the complaint cannot be said by any consumer because ‘Jabra Fan’ was shown on TV channels as a promotional song. They also stated it had been disclosed through the media that the song would not be a part of the movie.

Statement from NCDRC

NCDRC Stated that they cannot understand why the song Jabra Fan was not used in the film. It may be a reason that the producer thought people would come into theatres after watching the song in its trailer hoping that it will also feature in the movie.

The commission also said, “Though it is claimed that the producer and actor of the movie had declared publicly that the song which forms part of the promo would not be a part of the movie, the said disclosure, even if it was made, would not be sufficient since it is not necessary that a person who watches the promo containing the song would also happen to see the interview given by the actor/producer of the movie”.
